NO PURCHASE IS NECESSARY TO ENTER OR WIN.

Peloton Social Contest: Enter to Win a TCS New York Marathon Non-VIP Race Bib ("Contest") starts on September 26th, 2023 at 3:00pm EST and ends on October 3, 2023 at midnight EST ("Contest Period").

ELIGIBILITY: Contest is open to individuals who are Peloton Members prior to the opening of the Contest Period, who are legal residents of the fifty (50) United States and District of Columbia, and of 18 years of age or older. Employees of Peloton Interactive, Inc.("Sponsor"), its parent, subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. Individuals registered to participate in the 2023 TCS New York Marathon prior to the opening of the Contest Period are not eligible to enter or win. Void where prohibited by law. Contest is subject to all applicable federal, state and local laws. By participating, each entrant agrees to abide by these Official Rules and decisions of Sponsor and judges, which shall be final and binding in all respects relating to this Contest.

HOW TO ENTER: No Purchase necessary. During the Contest Period, to enter, submit an entry by completing the prompts included on the form ("Submission Form") available at https://docs.google.com/forms/d/e/1FAIpQLSfCA_I23s0EethZhbAFtq-YSxr3_2Cnxi8BXtVE5oW30L2ong/viewform?usp=sf_link ("Entry"). All entries must be received by October 3, 2023 at midnight EST. Entries generated by or suspected to be generated by script, macro or other automated means or by any means which subvert the entry process are void. Limit one (1) Entry per person for the entire Contest Period. Multiple Entries from any person will be void.

REQUIREMENTS OF ENTRIES: Entry must be the original work of the entrant, may not have been previously published, and may not have won previous awards. Entry may not contain, as determined by the Sponsor, in its sole discretion, any content that:

  • is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
  • promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
  • is obscene or offensive; endorses any form of hate or hate group; appears to duplicate any other submitted Entries;
  • defames, misrepresents or contains disparaging remarks about other people or companies;
  • contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission, to the extent permission is necessary;
  • contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
  • contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without permission, to the extent permission is necessary;
  • contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission;
  • contains look-alikes of celebrities or other public or private figures, living or dead;
  • communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate;
  • violates any law.

By submitting an Entry, you represent that the Entry conforms to these Official Rules and understand that Sponsor may disqualify the Entry for any reason, including if it determines, in its sole discretion, that the Entry fails to conform to these Official Rules in any way or otherwise contains unacceptable content.

WINNER DETERMINATION: Following the conclusion of the Contest Period, answers to the prompts included in the Submission Form(s) for all eligible Entries received will be judged and scored on or around October 5th, 2023 by a panel of qualified judges based on the following weighted criteria: (1) Embodiment of the Peloton community and values (50%), (2) Originality (30%), and (3) Responsiveness (20%) (the "Criteria"). The Entry(ies) that receives the highest score(s) will be deemed the potential winner(s). In the event of a tie for any prize, a tie-breaker judge will judge the tied Entries using the score of the highest weighted Criteria to determine the winner for that prize. Sponsor reserves the right to not award a prize if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries for that prize. All decisions of the Sponsor and judges are final and binding. Sponsor will not reveal the judging scores for any Entry.

WINNER NOTIFICATION: Potential winner(s) will be notified by email, and may be required to execute and return a Declaration of Eligibility, Liability and, unless prohibited, Publicity Release. If a potential winner does not respond to the initial notification within ten (10) days of the initial notification, does not timely return all required documentation, or if a prize notification or prize is returned as undeliverable, or such potential winner is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor's discretion, a runner-up will be notified.Prize will be available for pick up at the TCS New York Marathon Expo presented by New Balance in New York, NY, November 2-4, 2023. Winners must visit the Expo in person during posted pick-up hours to pick up their race materials, and must bring a valid photo ID and their runner confirmation form with them. TCS New York Marathon entries are non-transferrable. Exact address of pick up location will be supplied to winners within the emailed Winner Notification. All costs and expenses associated with collecting the prize will be the sole responsibility of the winners.

PRIZES (4): TCS New York Marathon Non-VIP Race Bibs. Approximate Retail Value ("ARV"): USD$295. Total ARV of all prizes: USD$1,180. Prizes are awarded "as is" with no warranty or guarantee, either express or implied. All federal, state and local taxes (including income and withholding taxes), if any, and all other costs and expenses associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the winners. For the avoidance of doubt, Prizes are not inclusive of any costs and expenses related to travel, lodging, food, or any other costs and expenses related to collecting the Prize or attending and participating in the TCS New York Marathon, and are the sole responsibility of the winners. In accepting a Prize, Winner agrees that they have read and acknowledged the New York Road Runners, Inc. guidelines and procedures available at https://www.nyrr.org/run/guidelines-and-procedures. Winners may not substitute, assign, defer or transfer prize, but Sponsor reserves the right, at its sole discretion, to substitute a prize of comparable or greater value. Prizes are not redeemable for cash. All prize details are at Sponsor's sole discretion. Limit one (1) prize per person.

PUBLICITY GRANT**.** By participating in the Contest, Entrant expressly grants permission for Sponsor and its designees to use entrant's name, biographical information, Social Platform username, voice, performance, photo and/or likeness in any and all media, now or hereafter devised, worldwide, in perpetuity, for internal, advertising, and other purposes without additional compensation, notification or permission, unless prohibited by applicable laws and regulations, and to the fullest extent permitted by applicable laws and regulations.

GRANT OF RIGHTS TO ENTRIES. Sponsor and its designees, successors, and assigns shall have the unrestricted and non-exclusive right to edit, adapt, publish, copy, display, perform, broadcast, modify, and/or otherwise use any or all Entries, alone or in combination with other material including but not limited to essays, photos and/or videos in any and all media, whether now known or later discovered (including, but not limited to, display on Sponsor's websites and social media), in perpetuity (or limited to 10 years if such a perpetual license is not allowed under applicable laws and regulations), without restriction of any kind whatsoever, without further compensation to the entrant or anyone else.

Entrant represents and warrants that: (i) entrant owns the Entry (to the extent applicable); and/or (ii) entrant has the sole and exclusive authority to grant the rights provided in the paragraph above. Entrant further represents and warrants that the consent of no other person or entity is required to enable the use of the Entry as described in the paragraph above, and that such use will not violate the rights of any third parties, including, but not limited to, copyright, trademark, privacy or publicity rights anywhere in the world. If entrants submit Entries that do not comply with the representations and warranties in this paragraph, such Entry may be ineligible and disqualified.

RELEASE OF LIABILITY.

By participating, entrant releases, indemnifies and holds harmless Sponsor, any other companies or related parties associated with this Contest, Meta Platforms, Inc., New York Road Runners, Inc., and each of its and their respective parent companies, subsidiaries, affiliates, owners, members, shareholders, directors, officers, employees and agents (each a "Releasee" and collectively the, "Releasees") from any and all liability for any injuries, loss or damage of any kind, including death, threatened or actual injury, loss or damage to any person, including sickness, disease, death and disability arising from or in connection with the Contest or receipt or use and/or misuse of any prize. Releasees are not responsible for lost, late, misdirected, delayed, inaccurate, illegible, garbled, stolen or incomplete Entries, emails, posts, comments, or communications of any kind; or for Entries not received for any reason or for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft, destruction, or unauthorized access to or alterations of Contest-related materials; or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive registration or other information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or social platform or any combination thereof; or for any other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing or judging of Entries, the announcement of the prizes, or in any Contest-related materials.

GENERAL CONDITIONS. Sponsor reserves the right to cancel or modify the Contest if fraud or any other factor impairs the integrity of the Contest. If there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if technical difficulties compromise the integrity of the Contest, Sponsor reserves the right in its sole discretion to void any Entry at issue (including disqualifying any individual who tampers or otherwise interferes with the Contest), and to cancel, terminate, modify, or suspend the Contest, in whole or in part, at any time without notice and determine the winners from among all non-suspect Entries received up to time of such action using the winner determination procedure set forth above or as it deems fair and appropriate.In the event Sponsor is prevented from continuing with the Contest as contemplated herein by any force majeure event, including but not limited to fire, flood, earthquake, pandemic, public health emergency, national emergency, explosion, labor dispute or strike, act of God or public enemy, or any federal, state or local government law, order, or regulation, provided these events qualify as force majeure events, then Sponsor shall have the right to modify, suspend, or terminate the Contest at any time.

CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAWS AND REGULATIONS.

CHOICE OF LAW. The Contest is governed by the laws of the United States and the State of New York, excluding conflicts of laws principles.
